Martyn’s Law – A Comprehensive View on the Terrorism (Protection of Premises) Bill

Martyn’s Law is Poised for Debate in Parliament

Martyn’s Law, also known as the Terrorism (Protection of Premises) Bill, is currently in the consultation stages in the UK. The government plans to introduce it to Parliament as soon as possible. The law aims to improve protective security and organizational preparedness by mandating that certain venues and events consider the risk of terrorism and prepare for how they would respond to an attack. 

The Bill will introduce a tiered model based on the capacity of the premises or event. Venues with a capacity of 100 to 799 people will fall under the Standard Tier, while those with a capacity of 800 or more will be in the Enhanced Tier. The requirements will include implementing reasonably practicable security measures, such as training and standard terrorism evaluations. 

The Core of Martyn’s Law – Purpose and Scope 

Martyn’s Law is a forward-thinking piece of legislation designed to fortify the defenses of publicly accessible spaces against terrorist activities, as outlined in the King’s Speech, November 7, 2023. Its primary purpose is to ensure that venues, especially those with a capacity of 800 or more, take necessary and proportionate steps to mitigate the risks posed by terrorism. This includes implementing tailored security and emergency communications measures that align with the size and nature of the venue. 

The scope of Martyn’s Law is broad, covering a wide range of public spaces, including shopping centers, town halls, and large event venues. These locations, which see significant foot traffic, are often prime targets for terrorist activities. By mandating enhanced security protocols, such as the deployment of mass notification systems and comprehensive emergency communication strategies, Martyn’s Law seeks to create a safer environment for all.  

In addition, the tiered system and emphasis on proportionality ensures that security measures are both effective and appropriate for the specific venue size and use, without imposing undue burdens on operators.

A dedicated regulator will be appointed to monitor and enforce compliance, with the authority to inspect qualifying premises. This ensures that venues are consistently adhering to the standards set forth by the law, and that any lapses in security are promptly addressed.
